LEGAL AND TERMS OF SERVICE

These Website Standard Terms and Conditions (these “Terms” or these “Website Standard Terms and Conditions”) contained herein on this webpage, shall govern your use of the website (LegalCostsWizard.com), including all pages within this website (collectively referred to herein below as this “Website”). These Terms apply in full force and effect to your use of this Website and by using this Website, you expressly accept all terms and conditions contained herein in full. You must not use this Website, if you have any objection to any of these Website Standard Terms and Conditions. LegalCostsWizard.com is owned by ParetoTime (Pty) Ltd Reg No: 2017/462253/0.

Payment

Once a Company/Firm/User has registered, Legal Costs Wizard allows each individual USER of the Company/Firm/User to draw 1 Bill at no charge for 30 days from date of registration, so that the individual USER can experiment, get the feel of the Legal Costs Wizard program and receive support from the Legal Costs Wizard team, to help make drawing of Bills easy.


Thereafter, if the Company/Firm/User wants to use the Legal Costs Wizard program, the Company/Firm/User is charged a subscription of R 350 per month for a 12-month period per each individual USER of the program, who are registered to the Company/Firm or working as an Individual User. An individual is allowed to draw 5 new Bills every 30 days on the program. The Company/ Firm /User has the option to pay R 3500 annually for each USER, which is a savings of R 700 (2 months free subscriptions). The USER will have access to both High Court and Magistrate Bills.


If an individual USER draws more than 5 Bills in the 30-day period, then the Company/ Firm /User must pay R 100 for every additional bill above the 5 bills. You will need to contact Legal Costs Wizard team regarding additional Bills.

If a Bill takes longer than 30 days to draw – no problem, once paid, a Company/ Firm /User can take as long as the Company/ Firm /User requires to complete or amend a particular Bill.


A Company/ Firm/ User will be charged a credit card subscription R 350 every 30 days for a year per USER regardless of whether the individual USER draws less than 5 New Bills in the 30-day period or none at all. By way of example, if the individual USER draws NO BILLS for a 30-day period, the Individual USER will still only be allowed to draw 5 new Bills for next 30-day period - no unused Bill Credits are carried over to the next 30-day period.


Payment is made by Credit Card, using the internationally recognised PAYFAST payment platform. A subscription amount of R 350 per USER, every 30 days, for a period of 12 months will be automatically deducted by PAYFAST from a Credit


Card chosen by the Company/Firm/User, OR alternatively the Company/Firm/ User can make an upfront Credit Card payment of R 3500 per USER allows use of the program for a period of 12 months. After a period of 12-months, the Company/Firm has the option to renew or cancel the subscription.


Legal Costs Wizard support is available to answer any further questions you may have regarding Payment.


Legal Costs Wizard reserves that right to amend LEGAL and TERMS of Service and to terminate the Company/Firm/User’s access to the program if the Company/Firm/User is not following the terms and conditions of use, or the Company/Firm/User use of the program is deemed detrimental by Legal Costs Wizard to the business the Legal Costs Wizard.

Intellectual Property Rights

Other than content you own, which you may have opted to include on this Website, under these Terms, Paretotime (Pty) and LegalCostsWizard.com and/or its licensors own all rights to the intellectual property and material contained in this Website, and all such rights are reserved. You are granted a limited license only, subject to the restrictions provided in these Terms, for purposes of viewing the material contained on this Website (LegalCostsWizard.com).

Restrictions

You are expressly and emphatically restricted from all of the following:

  • publishing any Website material in any media that may be damaging to this Website;
  • selling, sublicensing and/or otherwise commercializing any Website material whatsoever;
  • publicly performing and/or showing any Website material;
  • using this Website in any way that is, or may be, damaging to this Website;
  • using this Website in any way that may impact user access to this Website;
  • using this Website contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the Website, or to any person or business entity;
  • engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website, or while using this Website;
  • using this Website to engage in any advertising or marketing;

Certain areas of this Website are restricted from access by you and we may further restrict access by you to any other areas of this Website, at any time we (in our sole and absolute discretion) deem necessary. Any user ID and password you may have for this Website are confidential and you must maintain the confidentiality of such information. If the owners/management of the Website have reason to believe that you are making use of the Website without paying for the services used, your access to the website shall be terminated, and damages shall be claimed from you for the bills of cost drawn that you have not paid for.

Your Content

In these Website Standard Terms and Conditions, “Your Content” shall mean any audio, video, text, images or other material you choose to display on this Website. With respect to Your Content, by displaying it, you grant Paretotime (Pty) Ltd and LegalCostsWizard.com a non-exclusive, worldwide, irrevocable, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media. Your Content must be your own and must not be infringing on any third party’s rights. Paretotime (Pty) Ltd and LegalCostsWizard.com reserves the right to remove any of your content from this Website at any time, and for any reason, without notice.

No warranties

This Website is provided “as is,” with all and any of it’s faults, and Paretotime (Pty) Ltd and LegalCostsWizard.com makes no express or implied representations or warranties, of any kind relating to the correctness of the information contained on this Website or to the materials contained on this Website. Additionally, nothing contained on this Website shall be construed as providing consult or advice to you.

Limitation of liability

In no event shall Paretotime (Pty) Ltd and LegalCostsWizard.com, nor any of its officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of this Website, whether such liability is under contract, delict or otherwise, and Paretotime (Pty) Ltd and LegalCostsWizard.com, including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

Indemnification

You hereby indemnify to the fullest extent Paretotime (Pty) Ltd and LegalCostsWizard.com from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

Variation of Terms

Paretotime (Pty) Ltd and LegalCostsWizard.com are permitted to revise these Terms at any time as they see fit, and by using this Website you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use of this Website.

Assignment

Paretotime (Pty) Ltd and LegalCostsWizard.com shall be permitted to assign, transfer, and subcontract their rights and/or obligations under these Terms without any notification to or consent required from you. However, you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations whatsoever under these Terms.

Entire Agreement

These Terms, including any legal notices and disclaimers contained on this Website, constitute the entire agreement between Paretotime (Pty) Ltd and LegalCostsWizard.com and you in relation to your use of this Website, and supersede all prior agreements and understandings with respect to the same.

Governing Law & Jurisdiction

These Terms will be governed by and construed in accordance with the applicable laws of the country, and you consent to the jurisdiction of the Magistrates courts of South Africa for the resolution of any disputes.
